Infringement Notification – Claims

17 USC § 512(f) provides that any person who knowingly and willfully misrepresents certain particulars in a notification of infringement pursuant to 17 USC § 512(c)(3) shall be subject to civil damages, including costs and attorneys’ fees.

Please note that we may share your identity and information with the alleged infringer in any copyright infringement claim we receive. When submitting a claim, you understand and agree that your identity and claim may be communicated to the alleged infringer.

Counter Notification – Material Restoration

If you receive a notice that material was removed due to a claim of copyright infringement, you may provide us with a counter-notification in an effort to have the material in question restored to the Site. The notice must be in writing and sent to our DMCA Agent and must include the following information pursuant to 17 USC § 512(g)(3):

  1. Your physical or electronic signature.
  2. A description of the material that has been removed and the original location where the material existed before it was removed
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or if outside of the United States, for any judicial district in which the service provider is located) and that you will accept service of process from the person or company that provided the original notification of alleged infringement.
  5. Send your counter-notification via our Contact Us page. Email is strongly recommended.

Repeat Infringer Policy

We take copyright infringement very seriously. In accordance with our repeat infringer policy under the Digital Millennium Copyright Act, we maintain a list of DMCA notices sent by copyright holders and make every effort to identify any repeat infringers. Those who violate our internal repeat infringer policy will have their accounts terminated.
